Issues in a Divorce Case

There are a few main categories of issues that we have to tackle in a divorce case. Namely, those are division of property and debt, maintenance, child custody, child support, and attorneys’ fees. Not every issue will apply in every case. If there are no minor children involved, that will, obviously, eliminate child custody and child support from the issues on the table. Maintenance and attorneys’ fees are also issues that are case dependent. There can be many subsets of issues that arise under the context of the main issues. For example, when dealing with division of property, we may need to value a house or business. We could also have disputes as to separate versus marital property. Therefore, although there are only a few categories of issues faced in a divorce, they can become complex litigation actions that take time to resolve.
